Shipping:

Most in stock orders are shipped via UPS Ground within 24 hours unless otherwise specified.

Quoted shipping charges are for shipments to the continental U.S. only. Shipments to rural or residential addresses may incur an additional shipping charge of $2.00.

If the address that you provide with your order contains any mistakes which cause the delivery company to be unable to deliver the package, we will send your purchase again but shipping will then be charged again.

Damages in Shipment

Regardless of your shipping terms, we will assist you if the merchandise is verified as damaged in transit. If this occurs, please take the following action: 

• Do not accept a visibly damaged product until the person making the delivery has endorsed the air bill/bill of lading with a statement of the extent of the damage.
• If damage is concealed and found after unpacking, retain all packing material and immediately call us. Concealed damage must be reported within 24 hours.
• Notify us immediately of damages so that we can provide you with assistance on the claim with the freight carrier. When calling, please have the sales order number at hand.
• Please send us copies of all air bills/bills of lading and inspection reports.

Returns ,Exchanges, Cancellations and Warranty Service:

If you wish to cancel or change an order, you must do so by email (sales7@2wayradios.com) and/or fax (904) 262-8585 within one (1) hour of initial placement of your order. The only exception is if your order has not shipped from our office within 30-days of order placement. In the event that an order is cancelled or changed, outside of these time limitations, a 20% processing and restocking fee may be assessed.

In general, all internet sales are final. If an exception is made, a 20% restocking fee will be assessed and the following terms must be met:

1. Product must be in it's original packaging

2. All documentation must be returned

3. Product must be in new condition

Please note that the products listed on our site are warranted by their respective manufacturer. However, if within 30 days of receipt of your order, please contact us for replacement/warranty service.

Warranty Claims: We will assist you in seeking repair or replacement under the manufacturer’s warranty. Simply contact us. We make no implied warranties, including the implied warranties of merchantability or fitness for a particular purpose with respect to any goods or services sold to you.

Rental Equipment: Orders for rental radios are final. If an exception is made, and the rental equipment has already been programmed/configured for the customer, a fee of 1-days rental or 25% of the total rental (whichever is greater) may be assessed.

Rental Terms and Conditions 

1. These terms and conditions may not be altered in writing except in writing and signed by both parties.

2. LESSOR, at is option, may terminate or declare this contract void if LESSEE violates any of the terms and conditions contained herein.

3. LESSEE promises that (a) he is eligible under Part 90 of the FCC Rules; (b) he will apply to the FCC for authorization to operate EQUIPMENT if required by FCC Rules; (c) he will observe all statutory and regulatory requirements governing the operation of such EQUIPMENT.

4. LESSEE will not take EQUIPMENT outside area of operation specified on reverse side of this contract.

5. LESSEE will not sublease, mortgage, pledge, sell or otherwise encumber the EQUIPMENT.

6. LESSEE assumes all risks arising from the use of EQUIPMENT and understands and acknowledges that 100% coverage of area of operation is improbable.

7. LESSEE promises to hold LESSOR harmless from any claims resulting from us of the EQUIPMENT including, but not limited to, down time, materials or other consequential damages resulting from the use if EQUIPMENT.

8. Upon the expiration or termination of this contract, LESSEE, at LESSEE’S own expense promises to return leases EQUIPMENT to LESSOR in the same condition as when received by LESSEE, reasonable wear and tear excepted. The determination as to the condition of the EQUIPMENT shall be made by LESSOR.

9. LESSEE promises to pay for any loss or damage to the EQUIPMENT, including, but not limited to, loss or damage caused by THEFT, VANDALISM, OR MISUSE.

10. Total or partial destruction of any LEASES EQUIPMENT shall not relieve LESEE from duty to pay any rent herein provided.

11. Upon expiration or termination of this contract, LESSOR may enter LESSEE’S property to recover EQUIPMENT.

12. LESSEE agrees that there is no reimbursement for unused time.

13. LESSEE understands that LESSOR may hold any reimbursable EQUIPMENT DEPOSIT for up to ten days after the rental has been completed and it has determined that no loss has been sustained to the EQUIPMENT.

14. In the event that it becomes necessary to enforce the terms and/or conditions of this contract or to recover any sums due, LESSEE agrees to pay any attorney fees, court costs or costs of collection.

15. The decision by LESSOR to not enforce and provision of this contract shall not constitute a waiver of any provision.

Limitation of Liability:

In no event shall TCS WIRELESS be liable to you under any cause of action or claim of any nature whatsoever, regardless of whether characterized as tort, negligence, contract, warranty, or otherwise, for any loss of profits or other economic loss, including, but not limited to, such losses as (i) wages paid to your employees, (ii) lost revenue, (iii) lost use of equipment, (iv) purchase, lease, or other acquisition of replacement, substitute, or temporary equipment, facilities or services, (v) costs of capital, (vi) costs or losses related to downtime, (vii) manual labor costs, or (viii) any other indirect, incidental, special, consequential, or other similar damages arising out of any claim relating to your purchases of goods or services from TCS WIRELESS, including losses resulting from your general or particular requirements or needs, whether or not TCS WIRELESS, at time of contracting, had reason to know of such requirements or needs, and whether or not such losses could have been reasonable prevented by you by cover or otherwise. TCS WIRELESS' liability to you shall in no event exceed the purchase price of the nonconforming goods or services giving rise to TCS WIRELESS’ liability to you.

TCS WIRELESS controls and operates this site from its offices in Jacksonville, Florida USA. Consequently, any questions relating to these Terms and Conditions or their application in a particular situation shall be governed by the laws of the United States and the State of Florida. Any legal or equitable action of whatever nature brought by you against TCS WIRELESS arising out of or related in any respect to these Terms and Conditions or your purchases or other dealings with TCS WIRELESS shall be brought solely in either the United States District Court for the District of Florida or the appropriate court of the State of Florida located in the jurisdiction where TCS WIRELESS has its principal place of business.
